Public offer — agreement on the provision of travel services

This document is a public offer, that is, a formal proposal addressed to any individual. By submitting a request for a travel product, confirming it and making payment, you fully and unconditionally accept the terms set out below, in accordance with the acceptance rules of the Civil Code of the Republic of Uzbekistan. Please read it BEFORE paying.

1. Definitions

“The Agency” — TRIPTOUR LLC, tax ID 308894038, travel agency licence series T.A No. 0010-01, director Abdugafforov Abdullo Abduazim ugli. Registered address and head office: 48 Buyuk Ipak Yo‘li street, Tashkent.

“The Traveller” — an individual aged 18 or over ordering a travel product for themselves or on behalf of others. A Traveller ordering on behalf of others is responsible for passing these terms on to them.

“The Tour Operator” — the organisation that assembles the tour and ensures its performance. The Agency acts as the tour operator’s representative.

“Travel product” (tour) — a package of services combined under a single price: flights, accommodation, transfers, insurance and any other services stated in the contract.

“Booking” — a reservation confirmed by the tour operator. The parties’ obligations arise from the moment the booking is confirmed.

2. Subject of the agreement

The Agency provides the Traveller with services for selecting, booking and arranging a travel product, and the Traveller accepts and pays for them under these terms.

The specific content of the tour — destination, dates, hotel, room category, meal plan, number of travellers and price — is set out in the signed contract and the voucher. Where this offer and the contract differ, the SIGNED CONTRACT prevails.

Prices and tour listings on the website are provided for information and may change — they do not constitute a public offer. The final price is fixed when the booking is confirmed.

3. How a tour is arranged

The Traveller submits a request via the website, by phone or at an office. A request is not a booking — it merely expresses interest and places no obligation on the Traveller.

The Agency checks availability and the final price and informs the Traveller. If the Traveller agrees, a contract is concluded.

The contract number is assigned automatically by the Agency’s information system, which rules out duplicates and hand-written numbers.

Once the booking is confirmed, the Traveller receives a voucher and the necessary documents. Notifications are sent by SMS and to the contacts given in the contract. The Traveller is responsible for the accuracy of their phone number.

4. Price and payment

The tour price is stated in the contract. The price may be expressed in US dollars and paid in soum at the rate applicable on the payment date. The rate applied is recorded in the contract.

Payment methods: cash, bank card and bank transfer. Card details are processed on the bank’s side and are not stored by the Agency.

An initial payment of at least 50% of the tour price is made when the contract is concluded. The balance is paid no later than 14 days before departure. If fewer than 14 days remain at the time of signing, payment is made in full straight away.

A payment is deemed made once confirmed by the Agency’s finance department. A receipt is issued for every payment — please keep it.

Failure to pay by the deadline may lead to cancellation of the booking. In that case the retention rules in section 9 apply.

5. What the price includes and excludes

The price normally includes: flights (with the stated baggage allowance), accommodation in the chosen hotel, the meal plan stated in the contract, airport–hotel–airport transfers and a medical insurance policy.

The price normally EXCLUDES: consular fees and visa services, excursions, extra hotel services (minibar, spa, safe), personal expenses, excess baggage, hotel deposits and any services not expressly stated in the contract.

The exact list differs for each tour and is recorded IN THE CONTRACT. If in doubt, ask before signing — it is free and takes a minute.

6. The Agency’s obligations

To give the Traveller complete and accurate information about the tour: destination, hotel category, meals, flight times and services not included in the price.

Once payment is received, to place the booking with the tour operator and hand the Traveller the voucher and required documents.

To notify the Traveller as promptly as possible of material changes to the trip (departure time, hotel, dates).

To process the Traveller’s personal data in accordance with the privacy policy and to share it with third parties only to the extent needed for the trip.

7. The Traveller’s obligations

To provide accurate and complete details: name and surname exactly as in the passport, date of birth and phone number. If incorrect details require a ticket or booking to be reissued, the Traveller bears the cost.

To make payments by the deadlines set in the contract.

To check that documents are valid: passport validity, the absence of travel restrictions, and consent documents for minors.

To comply with the laws of the destination country and the rules of the hotel and carrier. The Traveller is responsible for any breach.

To arrive at the airport for check-in on time. Missing a flight due to lateness is treated as a cancellation and is non-refundable.

8. Documents, visas and border control

In visa matters the Agency only assists: it helps prepare and submit documents. The decision to grant or refuse a visa rests solely with the foreign consulate.

A visa refusal does not exempt the Traveller from the applicable cancellation terms: flights and hotels may already be booked. Consular fees are not refundable.

Refusal of entry or exit by border authorities is beyond the Agency’s control. In that case the amount paid is treated under the cancellation rules.

Passport validity: most countries require at least six months beyond the return date. This is the Traveller’s responsibility.

9. Changes and cancellation

The Traveller must request a change or cancellation in writing (an application at an office or an email to the address in the contract). The cancellation date is the date the Agency receives the request.

On cancellation, the actual costs of the tour operator, airline and hotel are retained. The amount retained depends on the fare: under some low fares, flights and hotels are entirely non-refundable. The exact figure is calculated after the request and communicated to the Traveller in writing.

If the Traveller cancels 30 days before departure, they reimburse the penalties charged by the tour operator and the receiving party. If they cancel 14 days before departure or later, the money paid is not returned — the retention is 100% of the tour price. PEAK PERIODS: over the New Year holidays and other seasonal travel periods, 100% is retained regardless of when the cancellation is made — the tour operator does not cancel such bookings.

Replacing the traveller with another person is possible where the tour operator allows it and the reissue costs are paid.

If cancellation is caused by the Agency or the tour operator, the Traveller receives a full refund or, with their consent, a transfer to another tour.

10. Liability and force majeure

The Agency is liable within the scope of its own obligations: accurate information, arranging the booking, handing over documents and transferring payment. The liability of the Agency (and the tour operator) is limited to the price of the travel product.

The Agency is not liable for: flight delays or cancellations by the airline, hotel service quality (where it matches the stated category), weather, strikes, traffic conditions or the safety of the Traveller’s personal belongings.

In cases of force majeure (natural disaster, war, epidemic, acts of state authorities, closure of air traffic) the parties are released from liability. The parties then settle accounts taking actual costs incurred into account.

11. Insurance

A medical insurance policy is included in the tour price unless the contract states otherwise. The cover terms and limits are set out in the policy.

In an insured event the Traveller must first call the insurer’s hotline shown on the policy. Costs incurred without notifying the insurer may not be reimbursed.

Cancellation insurance is a separate service, arranged on request.

12. Complaints and dispute resolution

Complaints about service quality should be raised as early as possible — during the trip — so the issue can be resolved on the spot. Hotline: +998 78 555 77 88 (24/7).

A written complaint should be submitted within 20 days of the end of the trip to info@triptour.uz or at an office, with supporting documents attached.

The Agency reviews the complaint within 10 working days and replies in writing.

If no agreement is reached, the dispute is resolved in court under the laws of the Republic of Uzbekistan.

13. Personal data

By accepting this offer, the Traveller consents to the processing of their personal data to the extent required to arrange the trip. The full procedure is set out in the privacy policy.

A Traveller ordering on behalf of others warrants that they have obtained those persons’ consent.

14. Final provisions and details

The offer takes effect when published on the website and remains in force until a new revision is issued. The Agency may amend the terms; amendments do not apply to contracts already concluded.

Matters not covered by this offer are governed by the laws of the Republic of Uzbekistan.
